El caso de Trayvon Martin es algo que inspira fuertes emociones de ambos lados de los personajes inmiscuidos y no hablemos lo que se puede decir del manejo mediatico y legal que se le ha dado tanto por los medios diz-que-noticiosos y la fiscalia que parece funcionar como un apendice del abogado de los padres del mozalbete fallecido. Esto es el ultimo "accidente" relacionado a el encausamiento del acusado y el manejo inflamatorio de este con miras a cargar los dados de cualquier jurado. Pero para los que viven debajo de una piedra, aqui les incluyo una vista cronologica de los eventos de este caso.

The February shooting death of Trayvon Martin, a black 17-year-old staying at a gated community in Sanford, Fla., was a minor local news story for weeks before exploding into the national media. Since then, the killing has both fascinated and repulsed the nation, touching on all sorts of cultural and racial issues, and becoming nightly fodder on the cable news shows. Here's a look at what happened and when in this complicated, still-unfolding tale:

February 26, 2012
While certain details remain a matter of heated disagreement, here's what we know: Neighborhood watch captain George Zimmerman, 28, was driving his SUV though his Orlando-area neighborhood (known as the "Retreat at Twin Lakes") when he called 911 to report "a real suspicious guy," a "black male" walking around. That was Martin, heading back to the house where he was staying after a 7-Eleven run. Martin was wearing a hooded sweatshirt and carrying a can of iced tea, a bag of Skittles, and his cellphone. Zimmerman followed Martin, and the two engaged in some sort of altercation. One of the two men cried for help before Zimmerman fired one shot into Martin's chest. Zimmerman was brought to the police station, pleaded self-defense, and has remained free since.

Less than 24 hours after a judge sets George Zimmerman's bond at $1 million, the shooter ponies up $100,000 (with the backing of $1 million in collateral), and is released from jail. Zimmerman must stay in Seminole County and will be electronically monitored. He is forbidden from obtaining a passport, going to the airport, or opening a bank account, and has a curfew every night from 6 p.m. to 6 a.m.

In taped recordings released by the Florida State Attorney's Office, a woman identified as Witness #9 alleges that Zimmerman molested her as a child. The unnamed woman, who is reportedly two years younger than Zimmerman and was not a witness to the February shooting, says her family was friends with Zimmerman's family, and that the alleged assaults began when she was 6 years old. Zimmerman's attorney fought to block the release of her claims, arguing that they are not relevant and that it would only "serve to reignite and potentially enhance the widespread public hostility toward Mr. Zimmerman."

A photograph of Trayvon Martin's corpse was mistakenly released by prosecutors on Thursday with the college transcripts of George Zimmerman, the neighborhood watchman who killed him.
According to The Smoking Gun, Florida prosecutors inadvertently distributed a photo of Trayvon Martin's corpse and copies of Zimmerman's college records, materials that are deemed confidential under Florida law and exempt from disclosure.
The Smoking Gun reports that Zimmerman's Seminole State College of Florida records were 61 pages in total and included his original application to the community college and his class transcripts. The documents revealed Zimmerman's poor grades and that he was on academic probation at the time of the shooting because his grade-point average dropped below 2.0, C grade average.
Mediaite reports that prosecutor Angela Corey's office included the documents in supplemental discovery records distributed Thursday to several media outlets. The media outlets were those that had paid fees to receive discovery provided by the government to Zimmerman’s lawyer, The Smoking Gun reports.
After Corey's office realized the error, one of her aides sent out an email that stated that the "photo depicting the killing of a person" was "confidential and exempt" under Florida state law.
The grainy photocopied image shows the corpse of the 17-year-old African American, moments after Zimmerman shot him dead. NY Daily News reports there was also a photograph showing the head wounds Zimmerman suffered during the alleged scuffle with Martin.
Zimmerman's college transcripts have, however, aroused interest because they show he was a mediocre student at Seminole State College, barely a C student. Sky News reports he was studying for a two-year associate degree in criminal jstice and did not graduate last year due to a failed class. But following the February 26 shooting of Martin, he was "issued administrative withdrawals" for three classes with "no fees charged against his account." He was on academic probation at the time of the Martin shooting.
NY Daily News reports that Zimmerman, according to the transcripts, got Ds in two criminal justice classes: Introduction to Criminal Justice and another course in juvenile delinquency.
He got a C in a course titled "Evil Minds, Violent Predators." He got an A in criminal litigation and a B in criminal investigation, according to the transcripts.
His overall grade point was lowered by is poor math and science grades. He got two Fs in algebra classes, NY Daily News reports.
Zimmerman’s academic records emerge after his defense team announced it would seek a hearing to clear him under Florida’s controversial “Stand Your Ground” law.
According to defense attorney Mark O'Mara, “The primary focus of a ‘Stand Your Ground’ hearing is whether George Zimmerman reasonably believed that his use of his weapon was necessary to prevent great bodily harm to himself at the hands of Trayvon Martin."
The "Stand Your Ground" law permits use of deadly force in circumstances that a person reasonably believes he is under threat of grievous bodily harm or a person believes his life is threatened.
The burden of proof in the hearings is on the defense rather on the prosecution. A judge and not a jury decides the case.
According to NY Daily News, if a judge rules in Zimmerman's favor under the "Stand Your Ground" law, it could prevent a trial and protect Zimmerman from future lawsuits.
Zimmerman has pleaded not guilty to second-degree murder and is free on $1 million bond.

Zimmerman Trial Gets Another New Judge
An appeals panel has ordered a second judge in George Zimmerman's trial for the murder of Florida teen Trayvon Martin to step down.


Defense attorneys for George Zimmerman, the 28-year-old neighborhood watch volunteer accused of second degree murder in the shooting death of Miami teen Trayvon Martin, won a legal victory this week by convincing an appeals court to replace the trial judge for a second time due to fears of judicial bias.

Deborah S. Nelson, 58, a veteran justice appointed to the bench in 1999 by then-Gov. Jeb Bush, will replace Justice Kenneth Lester after he was ordered Wednesday to step aside by the Fifth District Court of Appeal in Daytona Beach, Fla., the Orlando Sentinel reported. A three-judge panel ruled that Lester made “gratuitous, disparaging remarks” about Zimmerman in during the defendant’s $1 million bond hearing and that he advocated for his further criminal prosecution.

Lester, while setting Zimmerman’s bond, accused him of trying to manipulate the system and hide $130,000 he had made from a website he started to raise funds.
This is the second time the judge has been replaced in the trial, which is expected to begin next year. The first judge in the case, Jessica Recksiedler, recused herself just before Zimmerman’s initial bond hearing citing a conflict of interest; her husband works with Orlando lawyer Mark NeJame, who was the first attorney approached by Zimmerman’s family to represent him.

Zimmerman was released on $1 million bail in July. He stands accused of second-degree murder in the Feb. 26 shooting death of 17-year-old Trayvon Martin, an incident Zimmerman maintains was self-defense. Neither his defense lawyer Mark O’Mara nor Martin’s parents, Tracy Martin and Sybrina Fulton, have publicly commented on the latest developments.

The move came one day after a Florida appeals court granted Zimmerman's request for a new judge, saying the original judge's remarks put Zimmerman in reasonable fear of an unfair trial.

Zimmerman, 28, is charged with second-degree murder in the February 26 shooting death of teenager Trayvon Martin.

Tracy Martin on talking to Zimmerman: No His attorneys wanted Lester removed, saying language he used in a bail order disparaged their client's character and held over his head the threat of future criminal proceedings.

The Fifth District Court of Appeal agreed, and Lester was forced to disqualify himself.

Lester revoked Zimmerman's original $150,000 bond after learning Zimmerman and his wife, Shellie, failed to disclose more than $100,000 in donations from the public.

The judge then set a new bail of $1 million in July, and it was the language in that bail order that Zimmerman and his lawyers took issue with.

The court agreed with Zimmerman's attorneys that Lester "made gratuitous, disparaging remarks about Mr. Zimmerman's character; advocated for Mr. Zimmerman to be prosecuted for additional crimes; offered a personal opinion about the evidence for the prosecution; continued to hold over Mr. Zimmerman's head the threat of future contempt proceedings, and ultimately set a bond at $1,000,000."

The appeals court also agreed that Lester's remarks "created reasonable fear in Mr. Zimmerman that the court is biased against him, and, as a result of this prejudice cannot receive a fair and impartial trial or hearing by the trial court."

In his July bail order, Lester wrote that "under any defnition, the defendant has flouted the system" and "tried to manipulate the system when he has been presented the opportunity to do so."

Lester also wrote that it was his "personal opinion" that Zimmerman intentionally gave false or misleading information in his bail application -- which is a felony -- and he suggested the possibility of future contempt proceedings.

"Holding this over Mr. Zimmerman creates a horrible chilling effect on this case, on the defense presentation, and cements Mr. Zimmerman's fear that he will not get a fair trial from the trial court," the appeals court wrote.

Zimmerman is free after posting the $1 million bond.

The former neighborhood watch captain has pleaded not guilty to the charges and said he shot the 17-year-old Martin in self-defense after Martin attacked him. Martin, who was unarmed, was walking through a gated neighborhood in Sanford, Florida, to his father's girlfriend's house when he was killed.

The New York Times, CBS News, NBC and several other media companies on Thursday challenged an attempt by prosecutors in the George Zimmerman murder case to keep secret any subpoenas issued by defense attorneys and whatever evidence they might produce.

What Special Prosecutor Angela Corey is asking Circuit Judge Debra S. Nelson, according to a motion prepared by the media companies, is unjustifiable and out of line with what's required under Florida law.

"Closure simply cannot be ordered on a blanket, presumptive basis," wrote Scott Ponce, a Miami attorney representing more than a dozen news organizations, including The Wall Street Journal, Associated Press, The Tampa Bay Times and The Miami Herald.

At issue is Trayvon Martin's school records. Last month, O'Mara issued subpoenas, demanding Miami-Dade school officials produce records that would reveal the reason he was serving a 10-day suspension at the time of his death and any previous disciplinary issues.

The information also would reveal his grades, test scores, attendance records and other things, none of which is typically public information.

Police reported that Trayvon had been suspended after authorities found him on school property with an empty marijuana baggie. The Miami Herald reported he had been suspended earlier after he had defaced a door and was found with several pieces of women's jewelry in his backpack as well as a screwdriver, which they described as a burglary tool.

Lead prosecutor Bernie de la Rionda filed paperwork, asking the judge to keep secret whatever those subpoenas revealed. He also asked the judge to seal all future defense subpoena requests, at least until she could review them and decide whether they should be made public, and to hold secret hearings, if need be, to discuss the subpoenas and the evidence they produced.

In the media legal paperwork sent Thursday to De la Rionda and O'Mara, Ponce wrote that Florida case law does not allow what prosecutors are requesting: a blanket sealing of all future defense subpoenas and the evidence they produce, as well as an order prohibiting the public from attending future hearings about those issues.

The judge may decide that certain things should be kept from the public, Ponce wrote, but she must do it on an issue-by-issue basis and only after evaluating each subpoena and the evidence it produces to determine whether their release poses a threat to the administration of justice.

De la Rionda had chastised defense attorney Mark O'Mara's request for Trayvon's school records as a fishing expedition.

In paperwork filed last week, O'Mara argued that he was merely gathering evidence and following a "well thought out plan to focus on potentially relevant and admissible information."

He also pointed out that prosecutors had gathered Zimmerman's high-school records from Manassas, Va. "Yet, when the same exact documents are requested regarding Trayvon Martin, the state denigrates the request as a fishing expedition," O'Mara writes. "The irony is rich."

Zimmerman, 29, a Neighborhood Watch volunteer, is charged with second-degree murder. He shot Trayvon, an unarmed black 17-year-old, Feb. 26 in Sanford after calling police and describing him as suspicious.

Zimmerman says he fired in self-defense after Trayvon attacked him, pinned him to the ground and was pounding his head on a sidewalk.

..ORLANDO, Fla. (AP) — George Zimmerman sued NBC on Thursday, claiming he was defamed when the network edited his 911 call to police after the shooting of Trayvon Martin to make it sound like he was racist.

The former neighborhood watch volunteer filed the lawsuit seeking an undisclosed amount of money in Seminole County, outside Orlando. Also named in the complaint were three reporters covering the story for NBC or an NBC-owned television station.

The complaint said the airing of the edited call has inflicted emotional distress on Zimmerman, making him fear for his life and causing him to suffer nausea, insomnia and anxiety.

The lawsuit claims NBC edited his phone call to a dispatcher in February. In the call, Zimmerman describes following Martin in the gated community where he lived, just moments before he fatally shot the 17-year-old teen during a confrontation.

"NBC saw the death of Trayvon Martin not as a tragedy but as an opportunity to increase ratings, and so set about to create a myth that George Zimmerman was a racist and predatory villain," the lawsuit claims.

NBC spokeswoman Kathy Kelly-Brown said the network strongly disagreed with the accusations made in the complaint.

"There was no intent to portray Mr. Zimmerman unfairly," she said. "We intend to vigorously defend our position in court."

Three employees of the network or its Miami affiliate lost their jobs because of the changes.

Zimmerman is charged with second-degree murder but has pleaded not guilty, claiming self-defense under Florida's "stand your ground law."

The call viewers heard was trimmed to suggest that Zimmerman volunteered to police, with no prompting, that Martin was black: "This guy looks like he's up to no good. He looks black."

But the portion of the tape that was deleted had the 911 dispatcher asking Zimmerman if the person who had raised his suspicion was "black, white or Hispanic," to which Zimmerman responded, "He looks black."

SANFORD, Fla. — A judge in the case of a former neighborhood watch leader accused of shooting Florida teenager Trayvon Martin has denied a defense request to delay the trial.
George Zimmerman's attorneys presented a motion Tuesday asking Judge Debra Nelson to push the trial from mid-June back to November. They say the prosecutor has been slow in turning over needed evidence. The state attorney denied the accusation.
Judge Debra Nelson noted Zimmerman's lead attorney had been in the case nearly a year and says the problems he's having getting evidence are not insurmountable.
Zimmerman is claiming he acted in self-defense in shooting Martin last year and has pleaded not guilty to second-degree murder.

NBC doesn’t want to deal with George Zimmerman’s libel suit. In a Feb. 20 filing in the case, NBC Universal Media LLC asks a Florida circuit court to stay the case until the conclusion of Zimmerman’s June trial for second-degree murder of Trayvon Martin.

The procedural part of the motion — that the libel case and the criminal case overlap and can’t proceed smoothly at the same time — is far less interesting than the substantive case that lawyers for NBC News advance in defense of the network.

To recap Zimmerman’s case against NBC News: On the night that he shot Martin, Zimmerman called 911 and narrated his pursuit of the teenager in his gated community in Sanford, Fla. A March 27 edition of the “Today” show abridged the 911 tape, as follows:

Zimmerman: This guy looks like he’s up to no good. He looks black.

Here’s what that abridgment was abridging:

Zimmerman: This guy looks like he’s up to no good. Or he’s on drugs or something. It’s raining and he’s just walking around, looking about.
Dispatcher: OK, and this guy — is he black, white or Hispanic?
Zimmerman: He looks black

There’s a black-and-white difference between those two treatments. In the first, Zimmerman is an out-and-out racial profiler. In the second, he’s just a guy answering reasonable questions from an emergency dispatcher.

Among the important themes of NBC’s recent motion is the way other news outlets portrayed Zimmerman and the larger issues in the case. For example, it notes that a Reuters story played up the racial dimension of thing, quoting the Martin family’s lawyer, Benjamin Crump, as saying that race was the “600-pound elephant in the room.” It cites an early CBS piece noting that the case has “serious racial overtones.” It cites a Huffington Post account saying that “The martin family’s attorneys and black community leaders have said the teenager was profiled and targeted because he was young and black.” It cites a Christian Science Monitor account saying that “[f]or many tuning in across the nation, the shooting late last month in Florida of an unarmed black teenager by a suspicious neighborhood watch captain looks like a racially motivated murder.”

Further: Other news organizations, it notes, were forced to shorten their treatments of the 911 call, because it stretches for seven pages in transcript form. Accordingly, says the complaint:

[N]ewscasts across the country played relevant excerpts from the recording and newspapers and other publications similarly quoted only portions of it. On March 19, for example, the Los Angeles Times reported that “[t]he slaying has dominated social media and national news outlets in the wake of Friday’s release of 911 tapes in the Feb. 26 shooting. On the tapes is Zimmerman’s call to report Martin. ‘He’s got his hand in his waistband and he’s a black male,’ Zimmerman can be heard telling the dispatcher, saying he’s following Martin.”… Similarly, Fox News reported a summary of the call as follows: “On the 911 call, Zimmerman is heard describing Trayvon martin as a black man who appears to be, quote, up to no good and reaching in his pocket.” PBS’s “McLaughlin Group,” in a program taped March 23 and broadcast the weekend of March 23-24, summarized the Call this way:
MCLAUGHLIN: Here’s Zimmerman on the phone reporting to a 911 operator the presence of a suspicious person.

GEORGE ZIMMERMAN: He’s got his hand in his waistband and he’s a black male.
911 OPERATOR: Are you following him?
MR. ZIMMERMAN: Yeah.
911 OPERATOR: OK, we don’t need you to do that (End audiotaped segment)


To abridge, NBC News is saying it has some company. The Erik Wemple Blog would be interested to see whether a jury of Zimmerman’s peers would be blown away by the “McLaughlin Group” transcript.

NBC also expresses a bit of legal-brief umbrage over Zimmerman’s media offensive, the timing of which the network finds curious:

Zimmerman’s commencement of this defamation action coincides with his efforts both to raise additional funds for his criminal defense and to engender public sympathy for his cause. Indeed, promptly upon filing his Complaint in this case, Zimmerman established a fourth website devoted to developments in this defamation case.
For the record, that’s a modern media organization quibbling with someone else using modern media.

The defendants rest on firmer ground in arguing that the outcome of the criminal case could well obviate the civil one: “[I]f Zimmerman is convicted, that fact alone will constitute substantial evidence that the destruction of his reputation is the result of his own criminal conduct, and not of the broadcasts at issue which, like countless other news resports disseminated by media entities throughout the country, reported on the underlying events.”

Witness describes Zimmerman's injuries, phone call to wife

A resident of the Florida community where George Zimmerman shot Trayvon Martin last year told jurors Friday afternoon how he encountered a bloodied Zimmerman immediately after the confrontation and took pictures of the murder defendant's injuries.

State witness Joe Manalo testified that took the photos with his cell phone that showed blood on Zimmerman's lip and scalp.

"He had blood running down his nose from both nostrils and over his lips," Manalo told Prosecutor Bernie de la Rionda.

Manalo said Zimmerman asked him to call his wife, Shellie, and tell her that he just shot someone as cops arrived on the scene.

"He had a cell phone in his hand and he tossed it on the ground asking if I could call his wife," Manalo testified. "He gave me her number. I had a connection right away and said, 'Your husband has been involved in a shooting. He's detained by Sanford police.'"

"Just tell her I shot someone," Manalo recalled Zimmerman saying, to which he obliged.

On cross-examination, defense attorney Don West read a transcript of what Manalo claims Zimmerman told him after the shooting.

"This guy was beating me up and I was defending myself. I shot him," the statement read
.

West then asked Manalo, "George Zimmerman asked, 'Am I bleeding?'" Manalo confirmed that he did.

Manalo also confirmed his earlier statement that when the police officer asked him who shot Martin, Zimmerman replied immediately saying that he had.

Earlier on Friday, another neighbor, John Good, testified how he witnessed an MMA-style fracas between Zimmerman and Martin. He described seeing one person straddling another and throwing punches down at the person which he described in a statement as a "ground and pound."

Good said he was watching TV with his wife when they heard a noise and he went out to investigate, despite his wife warning him not to. At first, he thought a dog might be attacking someone, but as he moved closer, he said he observed what looked like "a tussle" between two people.

"It looked like a tussle," Good said. "I could only see one person. At one point, I yelled out, 'What's going on? Stop it,' I believe.

Under questioning by De la Rionda, Good said one of the combatants was straddling a man lying face up on the pavement, and throwing punches. The testimony appeared to corroborate Zimmerman's claims that he shot the 17-year-old African-American with a legally registered gun in self defense, as he was being pummeled.

"I could tell that the person on the bottom had a lighter skin color," testified Good, who also said the person on the bottom appeared to be wearing "white or red," while the one on top wore dark clothing. Zimmerman identified that day as Hispanic and was wearing a red jacket. That also would corroborate Zimmerman's claims he was on the losing end of a violent confrontation when he fired the fatal shot.

But Good said he did not see the person on top slam the other one's head into the pavement. Zimmerman had wounds to his scalp following the confrontation.

Good, who went back inside and was calling 911 when he heard a gunshot, listened as an audio recording of his call was played in the courtroom.

"It looks like there's a black guy down, and he's dead," Good said on the call.

During cross examination, defense attorney Mark O'Mara asked Good to be more specific as to the exact positions of the two men on the ground and even demonstrated in the courtroom asking for visual confirmation. He also asked what Good meant on the 911 call when he said the person on top was engaged in an "MMA-style" move of "ground and pound". The witness also said during testimony that the person on the bottom was unable to move under a flurry of punches.

When O'Mara asked him if the person on top was Martin, Good said: "Correct, that's what it looked like."

Good also said he believed the person on the bottom yelled for help, but later conceded that he was not 100 percent sure it was the person on the bottom calling for help while he was in his house placing the emergency call, only that it "sounded like" it came from the person being attacked.

During cross-examination, O'Mara got on his knees to recreate the fighting as he asked Good to walk him through it.

Good was also shown by O'Mara a picture of Martin in a 7-Eleven convenience store and said that the person on top during the struggle was wearing the same dark clothing in the image.

Questioning was then redirected back to the prosecutor who tried to discredit a strong testimony for the defense.

De La Rionda asked Good if he used the term "ground and pound" in his statements to investigators or if it was a Sanford Police Department investigator first used the term. Good replied that it was possible. De La Rionda also used water bottles to help demonstrate the position of Zimmerman and Martin and even got Good to concede that he did not actually see punches thrown and that he "only saw downward movement" of arms.

The testimony came as Zimmerman’s murder trial entered its fifth day Friday, a day after the former neighborhood watch volunteer's attorney tried to demonstrate that the woman who was on the phone with Trayvon Martin shortly before he was fatally shot was not believable because her story changed over the course of the last year.

An attorney for Martin’s family, meanwhile, suddenly declared Thursday that the high-profile case was not about race.

It’s not about racial profiling,” Daryl Parks told reporters. “He was profiled (criminally). George Zimmerman profiled him.”

Parks made the comments after prosecutors spent several days arguing that Zimmerman profiled the 17-year-old specifically because he was black. Asked why he changed his take on the matter, Parks replied: “We never claimed this was about race.”

Zimmerman, 29, has said he opened fire only after the teenager jumped him and began slamming his head against the concrete sidewalk. Zimmerman identifies himself as Hispanic and has denied that his confrontation with the black teenager had anything to do with race, as Martin's family and its supporters have claimed.

Zimmerman has pleaded not guilty, claiming self-defense. He could face life in prison if convicted.

SANFORD, Fla. — Prosecutors wrapped up their case against George Zimmerman on Friday afternoon after the mother and brother of teenager Trayvon Martin testified Friday that they believed the screams on a 911 call seconds before his death were his, not those of Zimmerman.

"I heard my son screaming," said Sybrina Fulton, who listened to the 911 tape of the final moments of his life on Feb. 26, 2012. Fulton said she had to listen to the tape only once to know it was her 17-year-old son. She also testified that she didn't think Trayvon was responsible for his own death.

Medical examiner Shiping Bao, who autopsied Trayvon's body a day following his death, said Trayvon died from a 9 mm gunshot wound to the heart. "My belief he was still alive, he was still in pain, he was still suffering'' in the moments after he was shot.

He also said he believed that based on his experience, he believed Travyon was alive for 1 to 10 minutes after he was shot by the weapon, which had "loose contact" with his body.

Following Bao's testimony, Zimmerman defense attorney Mark O'Mara attempted to have the case thrown out for lack of evidence and his client acquitted. "There's enormous evidence that my client acted in self-defense,'' O'Mara said. "There is no other reasonable hypothesis."

'Mara said prosecutors failed to prove that Zimmerman acted in ill-will, spite, or hatred which is needed to convict someone of second degree murder. "I would suggested there's no direct evidence to support second-degree murder," O'Mara said, adding that the state failed to provide enough circumstantial evidence to prove their case. He referenced multiple conflicting witnesses that themselves, he said, that created reasonable doubt.

Assistant State Attorney Richard Mantei argued that Zimmerman had repeatedly lied to investigators

Judge Debra Nelson had yet to rule on O'Mara's bid.

Several autopsy photos were shown of Trayvon's body including a close up of his left hand which had a cut with blood still visible. The jury stared at the photos that showed Trayvon's clenched hands, a bent leg and a close up of his face, his eyes and lips closed. The teen's mother was not in the courtroom when the photos were shown but Trayvon's father sat somberly looking at the pictures.


Bao said abrasions on two of Trayvon's fingers could have been caused before, after or during the struggle with Zimmerman, and could have come from punching someone, scraping against concrete or from falling after he was shot.

That information means Zimmerman's versions of events - that Trayvon punched him and banged Zimmerman's head into a concrete sidewalk - could be supported by the teen's autopsy.

O'Mara pressed Sybrina Fulton about when she heard the tape and whether she hoped the voice was her son's so she would know the teen hadn't caused his own death. "I didn't hope for anything," Fulton said. "I simply listened to the tape."

Trayvon's older brother, Jahvaris, a 22-year-old senior at Florida International University, also testified that after listening to the 911 tape 10 to 15 times, he also believed the screams were made by his brother.

The Fultons' testimony could be key to help jurors determine who was the aggressor in the case against Zimmerman, 29, on trial for second-degree murder for Trayvon's death. Zimmerman, the neighborhood watch volunteer who has pleaded not guilty, has said that he acted in self-defense after he was attacked.

State attorneys, who have called three dozen witnesses, have presented a theory that points to Zimmerman's motivation: frustrated by neighborhood burglaries, he wrongly profiled an innocent 17-year-old as a criminal, followed him, then shot and killed him after a struggle.

Despite the prosecution's efforts, several legal experts say the case against Zimmerman isn't strong and does not overcome the burden of reasonable doubt.

"There are significant weaknesses in the state's case — most importantly conflicting eyewitness accounts which themselves create reasonable doubt as to what happened that night," said Elizabeth Parker, a former prosecutor who is now a criminal defense attorney in Palm Beach, Fla.

Trayvon's death and the speculation that Zimmerman, who is Hispanic, profiled, followed and murdered him sparked protests around the country last year. Zimmerman, who faces life in prison if convicted, has maintained that race did not factor into his actions.
Prosecutors say they will call the medical examiner who examined Trayvon's body to testify.

Benjamin Crump, the attorney for Trayvon's family, has maintained that prosecutors have enough to convict Zimmerman. "There is overwhelming evidence that George Zimmerman murdered Trayvon Martin," he has said.

Eyewitness accounts concern Parker however, particularly the testimony from residents who lived nearby the shooting scene who told largely different stories.
Jonathan Good said he saw Trayvon on top of and striking Zimmerman moments before the teen was shot.

Selma Mora, who lived a couple of houses down from Good, said a person straddling on top of another person told her to call police. Minutes later, the same person who was on top, Zimmerman, was on his feet after a gunshot, Mora said.

Meanwhile, two key witnesses, Sanford Police Officer Christopher Serino, the lead investigator on the case, and Rachel Jeantel, a young woman who was on the phone with Trayvon moments before he died, did not significantly help the state, Parker said.
Serino agreed with prosecutors that Zimmerman may have been profiling Trayvon, who was black, but also said he believed Zimmerman was telling the truth when he said he was attacked by the teen he fatally shot. The judge later told the jury to disregard that Serino believed Zimmerman.

"Serino's testimony was frankly terrible for the state," said Randy Reep, a Jacksonville defense attorney. "The instruction from the judge to ignore his views of Zimmerman's honesty was the correct thing for the judge to do, but un-ringing that bell is impossible to do."

The investigator also told the jury no physical evidence or witness statements contradicted Zimmerman's claim of self-defense and that the medical examiner's report supported Zimmerman's version of events.

Meanwhile, Jeantel, 19, told jurors that Zimmerman stared at and then followed Trayvon who tried several times to run away. Trayvon was out of breath when he told Jeantel he had lost the man.

"It was kind of strange that a person kept watching and following," she said. "It was like being stalked."

Later, Trayvon told Jeantel the man was back and behind him, she said. Within seconds, she said she heard a "bump" and Trayvon saying "get off." The phone hung up and there was no answer when she called back.

However, Jeantel and defense attorney Don West sparred during a seven-hour cross-examination that was often contentious. Jeantel admitted during testimony that she had lied twice: She said she told Trayvon's family she was 16 when she was 18. She also said she lied about going to a hospital instead of Trayvon's funeral because she didn't want to see his body.

Jeantel also said when she was first interviewed by a state attorney, it was at Trayvon's mother's house. Sybrina Fulton, Trayvon's mother, was crying and Jeantel didn't want to upset her further, the teen said.

"Rachel Jeantel's testimony was crucial to the state's case," Parker said. "She was Trayvon's voice from the grave."

But Parker thought the high school senior came across as aggressive and hostile and that her version of the truth seemed to lack credibility.

The three most troubling issues with Jeantel were that her accounts regarding what she heard were not consistent, her testimony appeared to be inappropriately influenced by the state, and she didn't appear to take testifying seriously, Parker said.

Daryl Parks, another attorney for the family of Trayvon, said his clients were proud of Jeantel and that the teen stuck to what she heard, that Zimmerman was the aggressor.
"She is not a lawyer," Parks said. "She did her very best."
 
Other state witnesses testified that Trayvon's fingerprints and DNA were not found on the gun but his DNA was found on the right cuff of Zimmerman's jacket. They also said Zimmerman's DNA was not found under Trayvon's fingernails but it was found on a shirt Trayvon wore under his hoodie.
 
The jury also learned about Zimmerman's rejection letter from a Virginia police department, his course work for a class that discussed stand-your-ground and self-defense laws, and his application to do a police ride-along.
 
However, legal experts say prosecutors have not proven Zimmerman acted "imminently dangerous" and demonstrated a "depraved mind without regard for human life" — Florida's definition of second-degree murder.
 
"What they seem to have proved, instead, is a thoughtless, careless encounter that may have spiraled out of control," said Jules Epstein, a Widener University law professor, adding that the prosecution seemed to take an extreme view of the events.

SANFORD, Florida (Reuters) - Florida Judge Debra Nelson denied a defense request to dismiss the second-degree murder charge against George Zimmerman, ruling the jury should decide whether to convict the neighborhood watch volunteer who killed unarmed black teenager Trayvon Martin.

 

Zimmerman's defense lawyer had asked for the dismissal once prosecutors rested their case in chief, leading to arguments in which the defense said prosecutors failed to prove their case after nine days of testimony.

Prosecutors countered that Zimmerman offered at least three different explanations for how his confrontation with Martin began, casting down on his claim of self-defense.

"There are two people involved here. One of them's dead. One of them's a liar," prosecutor Richard Mantei said.
 

Nelson denied the defense motion immediately after arguments, and the defense then began its case.
 

Zimmerman, 29, killed Martin, 17, in the central Florida town of Sanford on February 26, 2012. Police initially declined to arrest Zimmerman, believing his claim of self-defense, but a special prosecutor brought a charge of second-degree murder 45 days later.

Earlier on Friday, Martin's mother said in court she recognized the voice of her son screaming for help in the background of an emergency call made to police moments before he died.
"I heard my son screaming," Fulton said.
 

The defense called as its first witness Zimmerman's mother, Gladys Zimmerman, who said it was her son screaming for help.
 

Testimony from voice-recognition experts has been ruled inadmissible in the trial on the grounds that it was impossible to tell from the brief, poor-quality recording whether it was Martin or Zimmerman calling for help.
 

In addition to Martin's mother, the state's final witnesses included his brother, 22-year-old Jahvaris Fulton, who said he too was convinced it was his brother who can be heard screaming on the recording.
 

UP TO 10 MINUTES TO DIE

After Martin's mother and brother testified, prosecutors called Shiping Bao, the central Florida medical examiner who performed the autopsy on Martin.
 

Bao said Martin did not die instantly, even though the lone bullet from Zimmerman's 9 mm Kel-Tec semi-automatic handgun pierced the right ventricle of his heart.
 

"It is my opinion that he was still alive, he was still in pain, he was still suffering," said Bao, even as he stressed Martin could not possibly have survived the wound.
 

"I believe that he was alive for one to 10 minutes after he was shot," Bao added.
 

Bao's testimony was accompanied by graphic photographs from the autopsy that were shown to jurors. He did not explain how Martin could have been in pain, if he lost consciousness before he died, and acknowledged that he previously said the youth may only have lived for up to three minutes after the shooting.

(CBS/AP) SANFORD, Fla. -- A nationally renowned gunshot wound expert testified Tuesday that Trayvon Martin's gunshot wound was consistent with accused murderer George Zimmerman's story that the teen was on top of him and leaning over when he was shot.

George Zimmerman, a former neighborhood watch captain standing trial in the teen's shooting death, has said Martin attacked him and was on top of him just before the fatal gunshot. Prosecutors have argued Zimmerman profiled the teen and started the confrontation.


Taking the stand for the defense, Dr. Vincent Di Maio, a forensic pathologist, said that Martin's gunshot wound was consistent with the gun's muzzle being against his clothing, which would have been two to four inches away from his body when he was shot.

"If you lean over someone, you notice the clothing tends to fall away from the chest," Di Maio said. "If instead you're lying on your back and someone shoots you, the clothing is going to be against your chest."

Trayvon Martin's mother, Sybrina Fulton, left the courtroom as Di Maio testified. The jury saw graphic photos of Trayvon Martin's gunshot wounds in court.

Who was the aggressor in the Feb. 26, 2012 altercation in the Sanford, Fla., gated community has been a key issue in Zimmerman's second-degree murder trial, which is in its eleventh day of testimony.

Di Maio said that Trayvon Martin would have been alive for about one to three minutes following the gunshot wound, but would have been able to move and speak for at least ten to fifteen seconds.

The testimony was a contrast to the remarks of a medical examiner who conducted Martin's autopsy, who said that the teen could have been alive for up to ten minutes after the gunshot. Dr. Shiping Bao also said he didn't believe Martin would have been able to move after receiving the shot.

Prosecutors have said that George Zimmerman told investigators he moved Martin's arms away from his body after the gunshot, although Martin was found with his arms tucked beneath his chest. Answering a question from defense attorney Don West, Di Maio said that someone may be able to move their arms after receiving a similar gunshot.

Zimmerman's injuries indicate "you've had severe force, it's not just like you bumped your head or something like that," Di Maio said.

Zimmerman's injuries were consistent with having his head hit against concrete more than once, Di Maio said. The former neighborhood watch captain said the teen smashed his head into a sidewalk several times before he claimed he acted in self-defense.

The testimony was a contrast to another medical examiner, Dr. Valerie Rao, who testified for prosecutors that Zimmerman had "insignificant" injuries that didn't appear to result from multiple impacts against concrete.

Pointing to photos of Zimmerman's injures, Di Maio also said Zimmerman's nose may have been fractured, an injury he said was consistent with being punched in the nose, as Zimmerman said Martin did.

Di Maio also said it's possible to receive trauma without visible wounds. "You can get severe trauma to the head without external injuries, actually," Di Maio said.




Di Maio also explained that if clothes taken into evidence are wet and packaged in plastic bags, and not paper bags, it can ruin the samples since "bacteria multiplies and you get mold and it stinks to high heaven." Defense attorneys believe DNA evidence found on Martin's hooded sweatshirt and undershirt was degraded since the clothing wasn't packaged properly.




Di Maio was still on the stand early Tuesday afternoon after court recessed for lunch.

 'Coulda beens,’ ‘what ifs’ not enough to convict Zimmerman: defense

George Zimmerman, accused of hatefully gunning down an African-American teenager, isn’t guilty of anything “except protecting his own life,” the former neighborhood watch volunteer’s attorney said Friday in closing arguments in the Sanford, Florida, man’s murder trial.

“How many ‘coulda beens’ have you heard from the state in this case,” attorney Mark O’Mara asked. “How many ‘what ifs’ have you heard from the state in this case? They don’t get to ask you that. No, no, no.”
“Do not give anybody the benefit of the doubt except for George Zimmerman,” O’Mara said.
Zimmerman, 29, is accused of second-degree murder for killing the 17-year-old on February 26, 2012. Prosecutors call Zimmerman a frustrated wannabe police officer who took the law into his own hands.
They say he decided on his own that Martin was one of the criminals who had been victimizing his neighborhood, tailed him against the advice of police dispatchers, and then wrongly shot him to death.
Zimmerman, however, has said he shot Martin in self-defense after the teenager charged him, pinning him to the ground and slamming his head into the concrete sidewalk.
The case sparked anger and debate nationwide about race relations and gun control and led to protests and rallies calling on authorities to charge Zimmerman, who is Hispanic, in Martin’s death.
O’Mara is expected to complete his arguments Friday morning. After that prosecutors will get another chance to talk to the six-woman jury before the case goes to them.
Judge Debra Nelson ruled Thursday that they will be allowed to consider manslaughter in addition to the original second-degree murder charge.

The prosecution
State prosecutor Bernie de la Rionda has argued that Zimmerman’s account that he fired his gun because he feared for his life does not hold up.
“He brought a gun to a struggle, to a fight that he started … wanting to make sure the victim didn’t get away,” the prosecutor said in his closing argument Thursday. “And now he wants you to let him off because he killed the only eyewitness, the victim Trayvon Martin, who was being followed by this man.”
Zimmerman, 29, did not testify when his defense team rested its case on Wednesday, but his words were front-and-center a day earlier.
The prosecutor sought to pick apart interviews Zimmerman had given to police and in the media.
Why would a scared man get out of his car and walk around after being told by a 911 dispatcher not to follow the victim? Did Zimmerman walk toward Martin, or did Martin come after him — as he seemingly said both? Should he have had more than a bloody nose and scratches on his head if he’d had his head slammed on the ground by the victim?
“(Zimmerman) always has an excuse, or they catch him in a lie,” de la Rionda said.
The trial kicked off June 24 with opening statements. The prosecution called 38 witnesses in nine days while the defense took parts of four days to call its witnesses.

The defense
O’Mara and his team have maintained that Zimmerman is not racist but fought Martin in self-defense during a struggle in which the teenager pummeled him. Martin was visiting his father who lived in the neighborhood, which Zimmerman said had experienced recent break-ins.
On the day the defense rested, O’Mara said Zimmerman was considering testifying.
“He really wanted to talk to his jury and tell them what he did, why he did it and what he was facing when he made that decision to fire the shot,” O’Mara told CNN’s “AC 360.”
But there was no need for him to testify, he said, because the state had not proven its case beyond a reasonable doubt.
Though expressing confidence in his defense, O’Mara said he fears that the jury might consider a compromised verdict.
We want a verdict based upon the facts and the law and that’s an acquittal,” he said.
The man tasked with representing Zimmerman said that, whatever the outcome, his client will not feel safe.
“There are a percentage of the population who are angry, they’re upset, and they may well take it out on him,” he said.

A nation, divided
The case has divided the nation on issues of race and gun laws.
After the shooting last year, police did not immediately charge Zimmerman, citing Florida’s “Stand Your Ground” law. The law allows those who believe they are in imminent danger to use deadly force to protect themselves.
Protesters took to city streets in support of the teen’s family. Some wore hoodies, as did Martin the night he was killed.
In April last year, the Florida state prosecutor stepped in and charged Zimmerman.
Supporters have maintained that the black teen was a victim of racial profiling, tailed by the defendant over the objection of police dispatchers, then wrongly shot. Zimmerman is Hispanic.

Mother vs. mother
In testimony, the mother of the victim and the mother of the defendant identified an anguished voice on a 911 tape as having come from their respective sons. On the night of the killing, as residents made 911 calls to report the altercation, yells for help can be heard in the background.
Various neighbors called 911 and described what they saw and heard. But none of them saw the entire altercation, according to testimony.
Some described hearing a gunshot.
The prosecution has said the absence of Martin’s DNA on the pistol Zimmerman was carrying disproves defense arguments that the teen grabbed the gun during the struggle.

Foam dummy, mystery
The deliberations cap a week of drama that included both sides using a foam dummy to describe the struggle.
Each side has used unusual means in an effort to prove its case.
Thursday’s closing argument marked the return of the dummy that had appeared a day earlier when O’Mara used it to show jurors the competing theories of what happened the night Martin died.
This time it was de la Rionda’s turn to characterize Zimmerman’s account.

The prosecutor questioned how Martin — while he was allegedly punching Zimmerman, slamming his head onto the pavement and covering his neck and mouth — could have also reached for the gun that Zimmerman said was in a holster inside his waistband, as the defense suggested.

Miami - Un adolescente de quince años fue arrestado por escribir en una cuenta de Twitter que cometerá un "asesinato masivo", si el exvigilante voluntario George Zimmerman es declarado inocente en el juicio que se le sigue en Florida por asesinato en segundo grado del muchacho negro Trayvon Martin.

"Si Zimmerman sale libre dispararé a todo el mundo en Zion (Illinois) causando un asesinato masivo, y saldré impune igual que Zimmerman", escribió el adolescente en su cuenta de Twitter, según recogió hoy el diario digital Lake County News-Sun.

La Policía de esa población ubicada en el estado de Illinois fue alertada del mensaje y procedió a la detención del adolescente, a quien se le presentaron cargos por conducta desordenada, aunque dijeron que no era creíble la amenaza.

El jurado en el juicio contra el exvigilante voluntario hispano George Zimmerman, de 29 años, que disparó y mató en 2012 en Florida al adolescente negro desarmado Trayvon Martin, de 17, comienza hoy su segundo día de deliberaciones.

Zimmerman afronta dos cargos por asesinato en segundo grado y homicidio involuntario, imputaciones que la defensa intentó desmontar ayer en su exposición de los argumentos de cierre con el argumento de que éste actuó en defensa propia y que una "duda razonable" es suficiente para declararle inocente.

El jurado se pronunciará sobre esas acusaciones en un tribunal de la pequeña población de Sanford, en el centro de Florida, donde se produjo el suceso fatal.

Los miembros del jurado deberán emitir un veredicto unánime y por escrito.

El exvigilante voluntario ha mantenido siempre que disparó en defensa propia contra Martin, quien regresaba de noche a la casa de la pareja de su padre y caminaba por la urbanización de la población de Sanford con la capucha del suéter puesta, lo que despertó las sospechas de Zimmerman.

Pero la Fiscalía retrató a Zimmerman como alguien que "se tomó la justicia por su mano", cuando vio a Martin caminando bajo la lluvia, y asumió que el chico "no era para nada bueno".

El fiscal Bernie de la Rionda describió a Martin como un "chico inocente de 17 años" a quien Zimmerman "identificó como un criminal", le persiguió, tras obviar la recomendación de la Policía, se enzarzó en una pelea con él y lo mató de un tiro a quemarropa.

La muerte de Martin polarizó la opinión estadounidense y generó fuertes protestas en el país cuando, inicialmente, el vigilante fue liberado y el jefe de la policía local presentó su renuncia.

Pero el movimiento de protesta encabezado por líderes cívicos de la comunidad afroamericana condujo al gobernador de Florida, Rick Scott, a nombrar a una fiscal especial, Angela Corey, para investigar el caso y llevarlo ante los tribunales.

Civil rights leaders seek new charges against Zimmerman

Angry civil rights groups on Sunday were pressing for new criminal charges following George Zimmerman's acquittal on second-degree murder and manslaughter in a Florida courtroom.

The NAACP website featured an online petition -- also posted on the liberal site MoveOn.org -- asking the Justice Department to bring federal charges against Zimmerman in the February 2012 fatal shooting of Trayvon Martin.

"The most fundamental of civil rights — the right to life — was violated the night George Zimmerman stalked and then took the life of Trayvon Martin," the petition says. "We ask that the Department of Justice file civil rights (criminal) charges against Mr. Zimmerman for this egregious violation."

Barbara Arnwine, executive director of the Lawyers' Committee for Civil Rights Under Law, issued a statement Sunday asking for federal civil rights charges and blasting the verdict as a "tragic miscarriage of justice." She also urged Trayvon's family to pursue a civil lawsuit.

"No matter how you look at this situation, if it were not for the actions of Mr. Zimmerman, Trayvon Martin would still be alive with his family today," Arnwine said.

She said she hoped the verdict would spark a national conversation about racial profiling and the "broken criminal justice system."

After the verdict was announced Saturday night, a clearly shaken NAACP President Benjamin Todd Jealous said, "This is a heartbreaking moment. This will confirm for many that the only problem with the New South is it occupies the same time and space as the old South."

He referenced another killing of a black youth that many have compared to the Trayvon Martin slaying, the 1955 killing of 14-year-old Emmett Till, who was killed in Mississippi for allegedly flirting with a white woman. "Trayvon Martin's case has focused a generation the same way that the Emmett Till case focused a generation 60 years ago. I had hoped that this time we would get a verdict that fit the gravity of the case."

The Rev. Al Sharpton, who led thousands of protesters in Sanford seeking a prosecution of Trayvon's killer, called the verdict "a sad day in the country" and "a slap in the face to those that believe in justice in this country."

"I think this is an atrocity," Sharpton said. "It is probably one of the worst situations that I have seen."

Jesse Jackson called the verdict "Old South justice."

"I'm disappointed and I'm saddened for the family," Jackson said.

While the jury's verdict was a crushing blow for many, there were no reports of serious unrest by early Sunday morning. Authorities in Martin's hometown of Miami and in Miami Gardens, where his father lives, said the streets were quiet.

Demonstrators took to the streets of four California cities, and there were reports of protesters breaking windows and damaging cars in Oakland, officials said early Sunday.

In Chicago, about 40 people chanted "Justice for Trayvon!" as they marched through the streets Saturday evening, according to The Chicago Tribune.

In Sanford, Tristan Bailey, 15, who was outside the Seminole County courthouse, was stunned after hearing the verdict. "I don't know what to say," said the teen, who identifies with Trayvon Martin. "He was just a teen, trying to live his dreams."

Shannon Mickey, 41, was also disappointed. "We were all nervous when we knew the verdict was coming down," Mickey said. "It was a sense of shock. And unbelievable sadness."

In Detroit, the Rev. Charles Williams II, president of the National Action Network of Michigan and pastor of Detroit's Historic King Solomon Baptist Church, said he planned a special prayer service at the church to pray for the Martin family.

"In the South, it's still hard for an African American to get justice," Williams said. "Mr. Zimmerman deserved at least manslaughter and the jury wouldn't even do that. There is not faith in the jurors or in the diversity of the process."

Williams said that National Action Network will examine legal options. "We're going to continue our calls for justice for Trayvon Martin," he said.

In Fort Myers, Fla., people voiced feelings of anger, dismay and concern about keeping the peace immediately following the verdict.

"Oh my goodness, this is unreal to me. I'm very upset," said Antoinette Anderson, 48, a school district employee who is African American. "It shows we're not equal in the justice system."

Joe D'Alessandro, a 74-year-old former state attorney who now has a private legal practice, had a different take: "I never thought the state had a second-degree murder case," he said. "Self-defense trumps all. I just hope there's no violence."

Despite his disappointment with the verdict, Jealous urged calm. "It's important that the public focus on the fact that there are still additional avenues for holding this man accountable and bringing him to justice," he said. "It is critical that people keep the peace and focus their energy on encouraging the federal authorities to make sure that Zimmerman is held accountable for taking young Trayvon Martin's life."

Jackson also called for calm. "I hope there will be dignity and discipline, and not street justice," he said. "We cannot dishonor the innocent blood of Trayvon Martin with acts of violence."

Tampa resident Craig Woodord brought his 13-year-old son, Dante, to the courthouse Saturday afternoon to watch history in the making. Dante wore a blue hooded sweatshirt and carried a bag of Skittles candy and a can of watermelon Arizona Iced Tea.

"My son's 13," Craig Woodord said. "And it could have been him. So my heart really, really goes out to the Martin family, who lost their son that was doing absolutely nothing wrong.

"But nobody wins tonight. George Zimmerman is free, but he has to come out into society – living with a lot of people that don't like him."

Dicho y hecho... Mientras se llevaba el caso, los grandes intereses etnio-políticos han estado moviendo palancas para matener a sus constituyentes y contribuyentes emocionalmente vinculados al caso y a los intereses políticos y pecuniarios de estas organizaciones políticas. Por Lo visto, y por presiones de algunas tribus sociopoliticas como el NAACP, el caso de derechos civiles contra Zimmerman es casi un hecho. Como es que no ocurre Lo mismo cuando un criminal de color victimiza a una persona por asumir que por Su raza va a llevar dinero encima?

George Zimmerman’s Acquittal Sparks Talk of Civil Lawsuit

The acquittal of George Zimmerman, the neighborhood watch coordinator cleared of Florida charges that he murdered black teenager Trayvon Martin, spurred new calls for a federal civil rights prosecution and suggestions that the youth’s family may bring a lawsuit.

The National Association for the Advancement of Colored People is pushing U.S. Attorney General Eric Holder to pursue a hate crimes case against Zimmerman, its head said yesterday on CNN’s “State of the Union” program. A Martin family lawyer, Benjamin Crump , said Martin’s parents would investigate filing a lawsuit outside Sanford, Florida, where the criminal trial was held.

“There is reason to be concerned that race was a factor in why he targeted young Trayvon” Ben Jealous, the NAACP president, said. “We know there will be a state phase, there will be a civil phase almost assuredly, and then there will be a civil rights phase,” he said.

The Justice Department yesterday reiterated a March 19, 2012, statement that it was investigating the “facts and circumstances” surrounding the shooting, and would take “appropriate action” at its probe’s conclusion.

“Experienced federal prosecutors will determine whether the evidence reveals a prosecutable violation of any of the limited federal criminal civil rights statutes within our jurisdiction, and whether federal prosecution is appropriate in accordance with the department’s policy governing successive federal prosecution following a state trial,” the department said in an e-mailed statement.

Wrongful Death In a wrongful death action against Zimmerman, Martin’s family would need to show he was culpable only by a preponderance of the evidence, according to Peter Grenier, a personal injury lawyer at Bode & Grenier LLP in Washington. The criminal case and acquittal, decided on the standard of beyond a reasonable doubt, would be irrelevant to the civil suit under Florida law, Grenier said.

O.J. Simpson, who was acquitted of murder in the stabbing deaths of his ex-wife, Nicole Brown Simpson, and Ron Goldman, was order to pay $33.5 million after losing a wrongful death trial.

Florida is a comparative fault state, meaning jurors would weigh both Martin’s and Zimmerman’s culpability.

In Florida, wrongful death suits claiming negligence must be filed within two years, while there’s no time limit for suits alleging intentional death. Most cases claim negligence so damages can be covered by the defendant’s homeowner’s insurance, Grenier said.

Verdict Anger Anger over the verdict in a case that has drawn national attention for its implications involving race and guns was confined yesterday mostly to statements and threats of further litigation against Zimmerman, 29, described by prosecutors as a police-officer wannabe. Scattered protests occurred in cities including San Francisco, New York and Chicago .

President Barack Obama said in a statement yesterday that “we are a nation of laws, and a jury has spoken. I now ask every American to respect the call for calm reflection from two parents who lost their young son.”

The six-woman jury on July 13 found Zimmerman not guilty of murder or the lesser possible charge of manslaughter for shooting 17-year-old Martin through the heart during a struggle at the townhouse complex where the youth was staying at the home of his father’s girlfriend.

Criminal Suspect Prosecutors alleged Zimmerman, whose father is white and mother is Hispanic, profiled Martin as a criminal suspect, then followed and confronted him, leading to the altercation in which the unarmed youth was killed.

Defense lawyers argued Zimmerman acted in self-defense, fearing for his life after Martin punched him in the face, knocked him to the ground and then pounded his head against the pavement. Zimmerman told police he drew the legally concealed 9 millimeter pistol he carried after Martin told him “You’re going to die tonight,” and tried to grab it.

Other organizations calling for a Justice Department prosecution include MoveOn.org , which said in a statement yesterday it has joined the NAACP in collecting signatures on a petition to push for a federal investigation. More than 100,000 people have already signed it, the group said.

The Lawyers’ Committee for Civil Rights Under Law, calling for Justice Department action, said the trial was “characterized by racial overtones from the beginning.”

Double Jeopardy Bringing a civil rights case wouldn’t be double jeopardy because it would be prosecuted by the U.S. under federal law, Christina Swarns, director of criminal justice at the NAACP Legal Defense Fund, said in a phone interview. Such cases after a state prosecution is rare, she said.

“They’re largely very high-profile, egregious cases like Rodney King and Matthew Shepard,” Swarns said. “We think this falls squarely in the handful of cases where they’ve taken action.”

Robert Valli, a lawyer at Valli Kane & Vagnini in New York, which represents the Louisiana State NAACP and other civil rights chapters, said the Justice Department will look at text messages , mobile phone records and Zimmerman’s background to decide whether Zimmerman targeted Martin because he was black.

Representative Steve King, a Republican of Iowa and member of the House Judiciary Committee, urged the Justice Department on “Fox News Sunday” to stay out of the matter.

Obama improperly made case into a political issue, he said.

Soon after Martin’s death, Obama said that if he had a son the child would have looked like Martin. Yesterday he urged all Americans ask themselves if they are “doing all they can to stem the tide of gun violence.”

Race Talk Jurors heard little about race in the trial until the closing arguments.

Mark O’Mara, Zimmerman’s lawyer, told jurors that the only people arrested for crimes in his client’s neighborhood were young black males. He also told jurors that when Zimmerman spotted Martin, the teenager was in front of a home that had been burglarized a few weeks earlier.

The prosecution asked jurors to consider how they would decide the case if the roles were reversed and it was Zimmerman who was shot dead by Martin while walking home in the rain wearing a hooded sweatshirt.

“This case is not about race, it’s about right and wrong, it’s that simple,” Assistant State Attorney John Guy argued.

Unidentified Jurors The jurors, whose identities were withheld throughout the proceeding, were given media requests for interviews before leaving the courthouse last night, and none expressed any interest, Michelle Kennedy, a court spokeswoman said on Twitter.

Kennedy said that any attempts to identify the jurors would violate Seminole County Circuit Judge Debra Nelson’s order requiring they remain anonymous. The issue of their identities will be addressed at a future hearing, she said.

It was the initial handling of the shooting by authorities in Sanford and Seminole County that sparked protests by civil rights leaders including Jesse Jackson and Al Sharpton. Law enforcement officials declined to arrest Zimmerman and conducted what critics called a cursory investigation, saying the state’s laws on self-defense, including the controversial 2005 Stand Your Ground law, tied their hands.

On March 22, 2012, Republican Governor Rick Scott appointed a special prosecutor to take over the probe, Angela Corey, the state attorney in Jacksonville, Florida.

Martin Profiled After the verdict, Corey said in a news conference that Martin was profiled.

“There’s no doubt he was profiled to be a criminal and if race was one of the aspects in George Zimmerman’s mind, then we believe that we put out the proof necessary to show that Zimmerman did profile Trayvon Martin,” Corey said.

“This isn’t over with,” Senate Majority Leader Harry Reid, a Nevada Democrat, said in an interview yesterday on NBC’s “Meet the Press” program. “I think the Justice Department’s going to take a look at this.”

The case is State of Florida v. Zimmerman, 1712FO4573, Florida Circuit Court, 18th Judicial Circuit, Seminole County (Sanford).

Zimmerman empieza el desquite.  Aqui esta solicitando lo que le corresponde bajo el estado de derecho...  Y todavia falta que empiece ademandar a los medios por su labor amarillista.  A personajes tales como Jesse Jackson y Al Sharpton, y demas personas que con malicia se prestaron para lincharlo publicamente  por motivos de lucro.

George Zimmerman wants the state of Florida to pick up the tab for his legal defense, just weeks after he was acquitted in the high-profile trial of Trayvon Martin’s death.



Zimmerman, who was found not guilty of murder last month in a case that riveted the nation and sparked pitched conversations about race, will ask that Florida foots a legal bill of up to $300,000, his lawyer told the Orlando Sentinel.



State law requires that Florida cover all legal expenses — except lawyer’s fees — for an acquitted defendant, from expert witnesses to the 3D videos shown to jurors.

Zimmerman is still preparing a motion that will ask for between $200,000 and $300,000 according to his lawyer.



Taxpayers have already shelled out an estimated $902,000 on the second-degree murder trial that ended July 13, the newspaper reports.
